lieved of certain responsibilities connected with a trust agreement whifch August Hill wealthy Reno land owner executed four years ago In a suit filed yesterday the bank stated that on September 23 1949 Mr Hill conveyed two pieces of business property to the irst Na tional to be held under terms of a trust agreement The agreement provided that the role in the trust would be inactive during the lifetime of Mr Hill However it also provided that in the event Mr Hill ever was de clared incompetent the bank would manage the properties for him The real estate involved was that occupied by Brown Motors and Hill and Sons Motel Two years ago Mr Hill was de clared incompetent in district court following some widely publicized marital difficulties When the bank stepped in to ad minister the properties under the trust agreement it found that Mr Hill had only a two fifths interest in them One fifth interests were also held by Charles Hill Mr and Mrs William Hill and Mr and Mrs red Hill In the suit filed yesterday the irst National Bank said that the properties were being properly managed by the other owners and that August guardian red erick Hill was keeping all the necessary records for his ward Consequently the bank asked that it be relieved from complying with the terms of the trust'agree ment as they applied to the even tuality of August Hill being de clared incompetent 2BKBQBB9BBBBBBS CARSON CITY Oct 27 Indian Commissioner Glenn Em mons told delegates to the Gover Interstate Indian Council to day that the administration favors increasing transfer of responsibility for Indian affairs to the Indians themselves and to the states The newly appointed commis sioncr a former resident of New Mexico a state with a large In dian population declared: me assure you we have no intention of simply walking out on the Indians of any particular area and dumping our problems in the laps of the Instead the Indian affairs bureau will seek the advice and coopera tion of the various Indian tribes and of the states which have In dian populations he said Emmons foresaw in the period ahead increasing assumption of in itiative and responsibility by In dians for the management of their own personal and tribal affairs This will be accompanied by steadily decreasing federal control and a broadening of the role played by the individual states and their political subdivisions Emmons told approximately 50 delegates from 17 states present for the three day conference Problems Differ He pointed out however that his talks with tribal groups throughout the western half of the nation had convinced him that differences in individual areas were such that In dian problems cannot be ap proached with the same yardstick The problems of each tribal group and of each state must be met in dividually he said He cited California where Indians are widely scattered and intermin gled with non Indian population already enjoying the same educa tion welfare and law enforcement rights as non Indians Yet in such states as Arizona and New Mexico he said Indians comprise a much larger bulk of the total population and are still com paratively isolated from the general populace on large acreages of tax exempt land He cautioned how ever that the Bureau of Indian Affairs has a financial responsi bility not only to the Indians but to the taxpayers as well He did not elaborate The nation he said could look forward to a steady reduction of the acreage of Indian trust land which currently has tax exempt stalus He pledged that all Indian groups will be consulted before we take any action or recommend any action that would alter their pres ent relations with the Indian bu Much of the afternoon session was devoted to hearing of reports from individual states of the fash ion in which Indian problems were being met and of those yet to be mastered The session will continue Wed nesday and Thursday in the assem bly chamber of the state capitol 13 Routine Cases Given Hearings Thirteen to explain reports oster held an Undisclosed interest in the club In the meantime Hewins sent the tax commission a letter saying oster was no longer connected with the casino and contending the Only owners of the establishment were himself lacometti Rosasco and Duffy The commission despite protests of Commissioner Paul McDermott of Las Vegas decided not to sum mon the four club owners for ques tioning Early this week oster told Commission Secretary Robbins Ca hill he wanted to appear before the commission to vindicate himself and to find out why he found him self unable to get a job in a Nevada casino Arrests Explained The ex bookmaker said yester 1 day he wanted to "clear up the record" also concerning two ar rests listed on his criminal record One concerned an indictment by New York authorities on March 24 1936 accusing him of stealing a large quantity of jewelry in that state He produced a copy of an official dismissal of those charges dated March 2 1944 He also exhibited a copy of a letter signed by Walter Gibson an employe of a fashionable New York jewelry firm saying he had mistaken rost or oster for someone else and saying also he was very sorry for the mistake rost explained that the letter was brought to him by the late Jack Sullivan former partner in Reno's Bank Club where rost was em ployed for many years rost said Sullivan happened to be in the jewelry store in New York and men tioned he was from Reno This rost asserted led to a dis cussion of the robbery case and to the jewelry clerk giving Sullivan the letter saying rost had been mistakenly identified extradition to New York had been denied in a writ of habeas corpus granted April 23 1936 by the late District Judge Barney Moran after several persons tes tified rost was time the alleged jewelry robbery occurred rost was also time upon a gun carrying charge in Los Angeles but he asserted this conviction had been appealed and later reversed Two Owners Blamed He blamed his troubles with the tax commission in part upon laco metti and Rosasco whom he said he believed had told one or more members of the tax commission and some of its investigative staff stories about his activities in the Palace Club which he denied were true These concerned he said his i assistance in counting the money following each shift at the casino and the fact he had a key to the main safe at the gambling club He said both men had also com plained to him about the fact Hew ins had offered to sell him a 10 per cent interest in the casino for $50 iOOO while they themselves had bought smaller percentages for a Palace Club at any time and also denied he wasfronting for anyone including Jo seph (Doc) Stacher with rost has occasionally beenassociated in rumors reaching tax commission officials rost said lacometti and Rosas co complained to him they were not present when the money boxeswere counted at the Palace but declared he told them anyone ever tell you you come in while the money was being He said his primary duty con sisted of counting money at the club and aiding Hewins in ing the money He said he had performed similar duties at the Bank Club for many years Understand Procedure He added commissioners did not question himself Hewins and Duffy at the time the license mat ter was brought up He added Hewins had told himhat a tax rommissinn official bad gone to one of the attorneys Model ordinance to control increasing smoke problem was presented to Reno city coun cil Monday night Councilmen moved to refer the proposed measure to the commit tee of the whole for further study The ordinance has been recom mended by the Regional Planning Commission following a careful study of conditions here It was noted that smog as such is not present in Reno However the smoke haze condition be comes acute every winter when temperature inversions cause the accumulated smoke to lie close to the ground On otherwise clear days airliners have had 1o make instrument landings at Hubbard ield due to the smoke In a letter to the city council the planners noted that the smoke difficulties are becoming progres sively worse and urged that the council take action on smoke con trol before the situation gets com pletely out of hand and a real smog develops The proposed ordinance sets forth smoke densities according the Ringlemann Chart which published by the Bureau Mines It would make it illegal permit emission of smoke of density equal to or greater than Density No 2 on the chart except for certain brief periods of time These briefs periods would permit firing of boilers and the like acids fumes and gasses which is declared to be a public nuisance The building inspector will be lhe control superintendent according to the measure His duties range from investigation of complaints to during the last year The Nevada State Tax Commission reported yesterday that the two per cent tax on gross gambling revenue yielded $1659717 setting an all time record and topping last collections by 26 per cent Commission Secretary Robbins Cahill explained that the 1953 totals included taxes paid by gambling clubs during the last three months of 1952 and the first nine months of this year Since the casinos paid a two per cent tax of $1659717 it can be as sumed that their gross revenue was 50 times that amount or $82985 850 It has been estimated that the gross revenue of the clubs is not more than five per cent of the total amount bet That being the case at leaat $1660000000 was wagered during the last year The vastness of that total can be appreciated by comparing it with the states assessed valuation ot about $345000000 Cahill said there was no indica tion of any letup in the steadily in creasing grass take by the gambling clubs The state collected $169625 from its table tax a sliding scale levy based upon the number of gambling games operated by a casino and paid in advance annually In 1952 the table Tax yielded $458500 and in 1951 $387000 Race wire service fees for 1953 amounted to $18040 They amount ed to $13440 in 1952 and $71688 in 1951 Penalties collected for various infractions of tax payment regula tions amounted to $8521 in 1953 as against $3244 in 1952 and
