Fred. 1240 Schools. Training Sullivan said the most important qualification for a judge is to make decisions "fairly and impartially." He agreed a District 6 judge must have wide experience to deal with a variety of cases. As deputy district attorney for Pershing County, he noted that he worked on criminal and civil cases, and advised county commissioners and planning, hospital and school boards. A life-long resident of northern Nevada, he has lived in Winme-mucca, Goldonda, Lovelock, McDermitt, Austin and Imlay.

Legarza's roots also are in northern Nevada. He was born in Winnemucca and attended schools in Fernley. His 15 years of courtroom experience includes numerous criminal and civil cases, ranging from misdemeaners to murder. Since becoming judge, he has been assigned by the Nevada Supreme Court to sit on district courts throughout the state, on three-judge panels for murder sentences and on the state high court itself. Admitted to practice in 1969, Legarza has served as a Humboldt County deputy district attorney and Winnemucca city Voters in Humboldt, Lander and Pershing counties have the only contested district court judge race in rural Nevada this year.

Incumbent District Court Judge Richard Legarza, 45, is being challenged by former Pershing County Deputy District Attorney Jerry Sullivan, 44. Legarza ran strong in a three-way primary that eliminated Humboldt County District Attorney Virginia Shane. He finished nearly 500 votes ahead of Sullivan, carrying Humboldt and Lander counties. But Sullivan won Pershing County, where he also served for a time as Lovelock city attorney. The only new issue to surface during the general election came in a letter to a Winnemucca news- Saper contending that Sullivan unked the State Bar exam twice before becoming an attorney.

"I am not ashamed that I have failed the Bar exam twice," Sullivan said at a candidates' forum in Winnemucca last week. "I had a family to support. I had to make a living first. Legarza has had the benefit of training at the taxpayers expense, he added. Former Gov.

He has not pressed the bar exam issue and the campaigns have been sedate, with the candidates listing their background qualifications and attributes they consider essential for a judge. A good judge must be "honest, impartial, firm, fair, compassionate, decisive, learned in the law and prepared for litigation," Legarza said. "He should not look over his shoulder at what's politically expedient. The judge for District 6 must be well qualified because he must wear several hats, Legarza added. Unlike larger districts, he has to handle probate, criminal, juvenile and civil matters, because there are no judges specializing in these matters in the small counties.

Dayton student sues, alleging rights violations A Dayton High School student has sued the Lyon County School Board and school officials, claiming she was wrongly accused of embezzling $103 from the student body and was subject to illegal searches. The student is seeking $300,000 for herself and $50,000 for any other students whose civil rights were violated by the school board. She. claims her illegal suspension led to heavy grade reductions, as well as higher automobile insurance rates because she wasn't allowed to finish her drivers education course. The student, who is suing along with her mother in U.S.

District Court in Reno, claims she was yanked into Dayton High School Principal Don Dirks' office in May 1983 and confronted about the alleged embezzlement. "I am not asking you, I'm telling you" she stole the money, the suit quotes Dirks as saying. It said the girl was ordered immediately to empty her pockets, after which her lockers were searched. According to the suit, the girl told school officials she "never embezzled anything." Criminal charges were also brought against the girl at the Lyon County Sheriff's Office, and despite the fact she has not been convicted of anything, the girl claims her school year was ruined by the suspension. She claims she missed her final exams, suffered severely in her drivers education grade and missed a youth leadership conference to which she was named a school delegate.

Eureka ranchers run for commission seat EUREKA Only one county commission race will be on Eureka County ballots Tuesday since District 3 Commissioner Hale Bailey is unopposed. Roy Etchegaray and Robert Martin are running for the District 1 seat being vacated by Charles Vacarro, who chose not to seek another term after serving 16 years on the commission. Both candidates are ranchers and lifetime residents of Eureka. Etchegaray is a past president and secretary of the Eureka County Farm Bureau. He defeated builder Mark Hokenga in a close Republican primary in September.

Martin, a Democrat, had no primary opposition. He has an interest in several mining claims with his brother Albert and has served on the Bureau of Land Management's Advisory Council. Etchegaray promised to "take a conservative and realistic approach to the county resources," and save tax money, while maintaining basic services. Martin could not be reached for comment. Pamela Buff ham and Floyd "Duke" Klindt are running for the county school board's Area 1C chair.

Ellingson rCARSON CITY Howard Phillip Ellingson, 72, died Monday at his residence. -A native of Ironton, 111., he was born Nov. 27, 1911, and had lived in Carson City for the past eight years, coming from Concord, Calif, where he had lived the last 40 years. EUingson was a retired butcher. Surviving are his widow, Maxine, of Carson City, son, Kenneth Howard of North Las Vegas, daughters, James J.

Land James J. Land, 54, died Friday in a Reno hospital. A native of Los Angeles, he was born Dec. 1, 1929, and had lived in Reno for the past two years, coming from California. He was a diesel mechanic and active in 4-H work, rodeos and served in the Coast Guard during World War II.

Survivors include his widow, Barbara and daughters, Jennifer, Tatianna, and Amanda Land, all of Reno. Cremation was at the Masonic Memorial Gardens Reno. A memorial mass is scheduled for 6 p.m. Friday at St. Michael's Catholic Church in Stead.

11, 1923, and had lived in Jacks Valley for the past seven years, coming from San Francisco. She was a homemaker and a member of the Order of the Eastern Star and the Family Service Agency in San Francisco. Survivors include her husband, John of Carson City; sons, Mark of Mesa, Ariz, and John III of Reno; daughter, Cheryl Ann Stevens of San Jose, Calif. and two grandchildren. Cremation will be at the Sierra Crematorium, Reno, under the direction of Walton's Chapel of the Valley, Carson City.

Herman F. Reynolds MARYSVILLE, Calif. A funeral is scheduled for 2 p.m. Thursday at the Truckee-Tahoe Mortuary for Herman F. Reynolds, 60, who died Sunday in a Sacramento hospital.

A native of Sheldon, he was born April 18, 1924, and had lived in Marysville for two years. He also had lived at Kings Beach, Calif. Reynolds was a security guard for Mill Weber Security Company. He was a member of the United Methodist Church and was in the Army for 13 years. Surviving are sons, Gary of Pittsville, Bobby of Swanton, Paul of Kings Beach and Michael of San Raphael, daughters, Linda Lockington, Desoto, and Roxanne Taylor of Marysville; stepsons, Donald Smith of Yuba City, and Ronald Smith of San Mateo, brother, Leo of Vermont; and 22 grandchildren.

Burial will be at the Sierra Mountain Cemetery, Truckee. Russell P. Robertshaw LOY ALTON, Calif. A funeral was held Tuesday at the Loyalton Church of Jesus Christ of Latter-day Saints for former Ruth resident Russell Paul Robertshaw, 68, who died Friday in a St. George, Utah hospital.

A native of Devils Slide, Utah, he was born Nov. 13, 1917, and moved to Ruth at an early age. Robertshaw drove a truck, drove bus for the Nevada Northern Railroad, worked for the Coca-Cola plant and was on the Ely police force. He moved to Loyalton in 1959. Surviving are his widow, Geneive of Loyalton; sister, Myrtle Meecham and a son, George, both of Ely; son, Walter of Sun Valley; and a daughter, Mary Rogerson of Lemmon Valley.

Raymond A. Scherf Raymond Albert Scherf, 41, of Lemmon Valley, died Tuesday in a Reno hospital. A native of San Francisco, he was born Dec. 2, 1942, and had lived in the area for five years, coming from Crescent City, Calif. He worked in the construction business and was a member of Layther Union for several years.

Surviving are his widow, Maryde of Lemmon Valley; son, Ronald of Reno; daughter, Debra Scherf of Chappaaua, N.Y.; stepdaughter, Christina L. Roberts of Eureka, mother, Vera Hiller, brother, Michael Fleming, sister, Edith Fleming and a grandmother, Stella Norvell, all of Crescent City, Calif. A private funeral will be held later.
